  1. Uploads of Materials in connection with the Scope of Services provided by WP Compress
Where applicable, all uploads to the Service are interpreted as User Submissions as per the appropriate applicable sections within our Terms of Service. User Submissions shall, for the purpose of providing the Scope of Services provided by WP Compress, include the material(s) provided to the service, in order to process the material(s), i.e. perform the Scope of Services. Please note that some functionality within the Service are limited to certain types of Subscriptions, further available on the Service’s Website. Upon executing the Scope of Services, WP Compress shall prompt you with a secure Upload and Download Protocol for your material(s) provided to the Service. Please note that the storage and backup of your files is made to a third-party server in a safe and encrypted form for the purpose of providing our image optimization services. We will store the backed up submission for the period as designated in this Privacy Policy. Please note that the backed up content may be restored or deleted at your request at any time. You hereby understand and accept the purpose for storage of your data for a period necessary for the purpose of processing of your data.

The Service is not liable for services rendered by third parties who render services for the benefit of Users on their own behalf and on their own account, in line with the rules and under separate agreements concluded with the Service or his Contractors, in particular with regard to the methods of payment. The Service’s failure to act in a particular circumstance does not waive the ability to act in respect to the specific circumstance or circumstances similar to it. If any provision of these Terms is rendered invalid by statutory provisions, interpretation of law or its application, rendered unenforceable, it shall not affect the remainder of these terms.   1. Termination of this Agreement
Termination of this Agreement may occur immediately as per the Service’s reserved rights in this Agreement. Termination of this Agreement on your behalf expressly means discontinuance of any subscription plans and paid services and deletion of your user profile. Please note that no refunds are issued for the unused prepaid paid services, and no renewals of subscriptions occur in the case you decide to re-register with our service. All due obligations of the Service to the Users shall be waived once this Agreement is terminated on the User’s behalf.

WP Compress’ Service, content and services are all provided “as is”. WP Compress does not unilaterally provide any express or implied terms, representations, warranties or conditions. WP Compress, its employees, offices, agents or other representatives are further not liable, to the maximum extent permitted by law for any: direct, indirect, special or consequential loss; business or private losses, including: income, savings, or profit loss, loss of contract, loss of goodwill or representations loss, warranty loss, data corruption, personal loss. The aforementioned limitations are voided in the exclusive case that WP Compress has willingly voided it’s limitation of liability in a specific Set of Terms and/or Contract. Limitations apply in the case that WP Compress had been advised of the potential loss. WP Compress does not take any responsibility for the unreasonable behavior of visitors and/or third parties.  Furthermore, WP Compress does not take any responsibility for publishing any content, which is not in any way meant to constitute and/or provide any type of professional advice. WP Compress is further not responsible in any way, to no extent in the unlikely case of severe host and/or server failure or breach, or any other Vis major, which is not in scope of WP Compress’ ability to control. This disclaimer cannot and will not exclude any warranty or liability implied by U.S. Governing law, will not exclude and/or limit any warranty or liability which is illegal or unlawful to limit or exclude in compliance with U.S. Governing law. You hereby understand this liability limitation statement, and are fully compliant with it in its entirety.  
  1. Dispute-Resolution
The Parties agree to solve all disputes or controversies, including those arising from termination of employment in a manner other than filing court actions, namely by Arbitration. The parties hereby agree to choose the Appointing Authority and the Place and Seat of Arbitration within the place of incorporation of WP Compress. For the purposes of this Section, Alternative dispute-resolution prevents statute barring of the rights and obligations arising from this Agreement. If these dispute-resolving methods prove unsuccessful, they are to commence court proceedings. If any provision of this Agreement is, or is to be found by an appropriate authority, unenforceable under governing law, that will not affect the enforceability of any other provisions of this Agreement.  The parties covenant and agree that the applicable and usable law according to which this agreement will be governed will be the law governing the existence of WP Compress. Subsequently to the aforementioned, the law governing the existence of WP Compress shall regulate all disputes or litigation arising from the content of this contract or its execution, accordingly.

Providing feedback may be possible by any given means within the Service. All feedback given in the form of user comments, blog posts or similar feeds shall be available to the World Wide Web. Please refrain from using any obscenity or profanity, as the Service reserves all discretional rights as per this Agreement.   5. kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods than required as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required by the GDPR in order to safeguard the rights and freedoms of individuals; and
  6. processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.

2. General provisions

  1. This policy applies to all personal data processed by WP Compress.
  2. The Responsible Person shall take responsibility for WP Compress’ ongoing compliance with this policy.
  3. This policy shall be reviewed at least annually.

Data protection risks

This policy helps to protect WP Compress from data security risks, including:

  • breaches of confidentiality, for example information being given out or exposed without proper authorization
  • failing to give choice, for example, all individuals should be free to choose how the company uses data relating to them
  • reputational damage, for example, the company could suffer if unauthorized individuals successfully gained access to sensitive data.

Responsibilities

Everyone who works for or with WP Compress has some responsibility for making sure that data are collected, stored, and processed appropriately. Each individual who handles personal data must make sure that the data are handled and processed in line with this policy and the principles of data protection.

General employee guidelines

  • The only people able to access data covered by this policy should be those who need it for their work.
  • Data should not be shared with others without appropriate authorization. When access to and the sharing of confidential information is required, employees can request it from their supervisors.
  • WP Compress will provide training to all employees to help them understand their responsibilities when handling data and confidential information.
  • Employees should keep all data secure by taking reasonable precautions and following the guidelines below.
  • Strong passwords must be used and should never be shared.
  • Personal data should not be disclosed to unauthorized people within the company nor externally.
  • Data should be regularly reviewed and updated if they are found to be out of date. If no longer required, they should be deleted and disposed of using appropriate security procedures.
  • Employees should request help from their supervisors or a data protection officer if they are unsure about any aspect of data protection procedures.

Data storage

  • These rules describe how and where personal data should be safely stored. Questions about safely storing personal data can be directed to the IT manager or data controller.
  • When personal data are stored on paper, they should be kept in a secure place where unauthorized people cannot see them.
  • These guidelines also apply to personal data that are usually stored electronically but have been printed out for some reason:
  • When not required, the paper or files should be kept in a locked drawer, filing cabinet, or environment.
  • Employees and contractors should make sure that paper and printouts are not left where unauthorized people could see them, such as in copiers or printers.
  • Printouts of personal data should be shredded and disposed of securely when no longer needed.
  • When data are stored electronically, they must be protected from unauthorized access, accidental deletion, and malicious hacking attempts.
  • Personal data should be protected by strong passwords that are changed regularly and never shared among employees nor contractors.
  • If personal data are stored on removable media such as a DVD, CD, or portable drive, they should be kept locked away securely when not used.
  • Personal data should only be stored on designated drives and servers and should only be uploaded to approved and secure cloud computing services.
  • Servers containing personal data should be situated in a secure location away from general offices and visitor traffic.
  • All data should be backed up frequently and securely. Backups should regularly be tested in line with the company’s standard backup procedures.
  • Personal data should never be saved directly to laptops, portable drives, tablets, nor smart phones.
  • All computers and servers containing personal data should be protected by approved firewall and security software.

3. Lawful, fair and transparent processing

  1. To ensure its processing of data is lawful, fair and transparent, WP Compress shall maintain a Register of Systems.
  2. The Register of Systems shall be reviewed at least annually.
  3. Individuals have the right to access their personal data and any such requests made to WP Compress shall be dealt with in a timely manner.

4. Lawful purposes

  1. All data processed by WP Compress must be done on one of the following lawful bases: consent, contract, legal obligation, vital interests, public task or legitimate interests (see ICO guidance for more information).
  2. WP Compress shall note the appropriate lawful basis in the Register of Systems.
  3. Where consent is relied upon as a lawful basis for processing data, evidence of opt-in consent shall be kept with the personal data.
  4. Where communications are sent to individuals based on their consent, the option for the individual to revoke their consent should be clearly available and systems should be in place to ensure such revocation is reflected accurately in WP Compress’ systems.

5. Data minimization

WP Compress will make sure that personal information are sufficient, pertinent and minimal to what is necessary in relation to the purposes for which they are processed.

6. Accuracy

  1. WP Compress shall take reasonable steps to ensure personal data is accurate.
  2. Where necessary for the lawful basis on which data is processed, steps shall be put in place to ensure that personal data is kept up to date.
  3. The law requires WP Compress to take reasonable steps to make sure that personal data are kept accurate and up to date.
  4. The more important it is that the personal data are accurate, the more effort WP Compress should put into guaranteeing their accuracy.
  5. It is the responsibility of all employees, contractors, and others who work with personal data to take reasonable steps to keep personal data as accurate and up to date as possible.
  6. Personal data will be held in as few places as necessary. Company employees and contractors should not create unnecessary additional data sets.
  7. Company employees and contractors should take every opportunity to make sure that data are updated. For example, by confirming customers’ information when they call.
  8. WP Compress will make it easy for data subjects to update the information WP Compress holds about them. As an example, by using the company website, Internet portal, by email or by phone.
  9. Personal data should be updated when inaccuracies are discovered. For instance, if a customer can no longer be reached on their stored telephone number, it should be removed from the database.
  10. It is the marketing manager’s responsibility to make sure that marketing databases are checked and updated against industry suppression files yearly.

7. Archiving / removal

  1. To ensure that personal data is kept for no longer than necessary, WP Compress shall put in place an archiving policy for each area in which personal data is processed and review this process annually.
  2. The archiving policy shall consider what data should/must be retained, for how long, and why.

8. Security

  1. WP Compress shall ensure that personal data is stored securely using modern software that is kept-up-to-date.
  2. Access to personal data shall be limited to personnel who need access and appropriate security should be in place to avoid unauthorised sharing of information.
  3. When personal data is deleted this should be done safely such that the data is irrecoverable.
  4. Appropriate back-up and disaster recovery solutions shall be in place.

9. Breach

In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data, WP Compress shall promptly assess the risk to people’s rights and freedoms and if appropriate report this breach to the ICO (more information on the ICO website)

10. Providing information

WP Compress does its best to make sure that individuals are aware that their data are being processed, and that they understand:

  • how their personal data are being used
  • how to exercise their rights under the law.

Subject access requests

All individuals who are the subjects of personal data held by WP Compress are entitled to:

  • ask what information the company holds about them and why
  • ask how to gain access to it
  • know how to keep it up to date
  • know how the company is meeting its data protection obligations.

If an individual contacts the company requesting this information, this is called a subject access request (SAR).

SARs from individuals should be made by email addressed to the data controller by using the contact information at the bottom of this policy or via live chat support. The data controller can supply a standard request form, although individuals do not have to use it.

The data controller will provide the relevant data within 30 days from receiving the request. The data controller will always verify the identity of anyone making a subject access request before providing them with any information.
